Heard learned counsel for the applicant and learned AGA for the State.
The applicant is in jail since 22.05.2010 in connection with Case Crime No. 505 of 2010 under Section 392, 411 IPC. I have perused the entire record. The applicant admitted that her husband had given Payal 4-5 days before and after getting knowledge about arrest of her husband, she was going to sell the same and do Pairvi for the case. The offence under Section 411 IPC is only made out against the applicant, who is a lady and has a small child. Her case is distinguishable from the main accused alleged to have looted silver payal. Since the case of the applicant is distinguishable from her husband and other co-accused, she is entitled for bail. Taking into consideration facts and circumstances of the case, without expressing any opinion on merits, bail application is allowed.
Let the applicant Smt. Rajani alias Guddi wife of Devendra Singh involved in Case Crime No. 505 of 2010 under Section 393, 411 IPC, P.S. Hari Parvat, District Agra be released on bail on her executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
