Heard learned counsel for the petitioner.
This writ petition has been filed praying for a direction to the opposite party No.2 to decide the Appeal No. C-201910000000699, Rajrani Vs. Sub Divisional Magistrate, Tehsil Sadar, District Unnao, at the earliest.
It has been submitted that the appeal was filed by the petitioner against the order passed the the licensing authority, cancelling her fair price shop license. The appeal has been admitted on 04.04.2019 and record has been summoned of the licensing authority.
Under the Act No.13 of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016, there is a provision for deciding the appeal within 60 days. In the present case the appeal has been pending for the past four months.
Without entering into the merits of the controversy, this petition is disposed of with the direction to the opposite party No.2 to decide the pending appeal at the earliest, say, within a period of two months from the date of production of certified copy of this order.
