By this petition, a challenge has been made to the order dated 11.12.2003 passed by the respondent no. 2. A further challenge is made to the Challan dated 10.10.2003.
An interim order was passed by this Court on 06.02.2004 for release of the vehicle subject to furnishing a bank guarantee of Rs. 45,000/-. It is said that vehicle was released on furnishing of bank guarantee. It is also stated that petitioner had availed the remedy of appeal before the Transport Appellate Tribunal. If that is the position, the outcome of the appeal would govern the fate of the petitioner because the order under challenge in this writ petition was finally challenged before the Tribunal.
Accordingly, we dispose of this writ petition with a clarification that parties would be governed by the outcome of the appeal or if, it was subsequently challenged by any of the parties, then by the final order. The release of bank guarantee furnished by the petitioner would also be governed by the outcome of the appeal or subsequent order, if any, passed by the competent court.
