Heard learned counsel for the petitioners and also learned A.GA. appearing for the State.
We have been taken through the allegations contained in the F.I.R. and the material on record.
The petitioner no.1 Smt. Rahamat Bee and petitioner no.2 Imran duly identified by their counsel are present before us.
Notice has been accepted on behalf of respondent Nos. 1 and 2 by the learned A.G.A.
Issue notice to respondent No.3 who may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder Affidavit may thereafter be filed within two weeks.
Steps will be taken within a week.
List this matter after expiry of the aforesaid period.
Till the next date of listing or till submission of the police report whichever is earlier, the arrest of the petitioners, namely, (1) Smt. Rahamat Bee (2) Imran (3) Faheem, (4) Qaeum and (5) Akeel who are involved in Case Crime No. 356 of 2012 udner sections 363, 366, 504, 506 I.P.C. police station Ujhanai district Budaun, shall remain stayed subject to the restraint that the petitioners shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation.
