It is said that the marriage of the detenue has been performed with one Atul Singh on 05.06.2009. It is said that an application for registration of marriage was also given on 27.07.2009. The statement under Section 164 Cr.P.C. has also brought on record which is in favour of the next friend. In medical examination her age has been assessed as 18 years. It is said that the date of birth is 25.09.1989 as shown in the High School Certificate. But there is an F.I.R. under Sections 363, 366 I.P.C. which has been registered on 22.07.2009 wherein the incident has been shown to be of 11.07.2009 which is after the performance of the alleged marriage.
In view of the above, let notice be issued to opposite party no.2 to produce the corpus or to show cause on 05.03.2010.
