Heard learned counsel for the petitioner.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to direct the respondents not to interfere in the peaceful possession of the petitioner in her domestic house E.W.S. No.957/2018, E-56, Shastri Puram, Agra during the pendency of Original Suit No.957 of 2018 (Smt. Pushpa Devi Vs. Smt. Aran Sharma & another).
It is argued by learned counsel for the petitioner that along with the Suit No.957 of 2018, petitioner also filed an application for grant of interim relief. It is argued that though the cogent reasons have been given for grant of ex-parte interim injunction in the application but only notices were issued by the court below to the opposite party vide order dated 04.09.2018. It is argued that the interim protection is urgently required. It is argued that in the absence of interim injunction, the respondents are bent upon to disposes the petitioner. It is argued that large number of dates were fixed in the matter but till date no final decision has been taken on the same.
Heard learned counsel for the petitioner and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law most expeditiously and preferably within a period of four months from the date of production of a self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
Till 30th June, 2021 or till the disposal of the aforesaid application whichever is earlier, parties are directed to maintain status quo as on today.
