Heard learned counsel for the petitioners and learned Additional Government Advocate. Caveat on behalf of opposite party no. 2 has been filed by Sri Praveen Kumar Gupta, Advocate, but he is not present.
The present Writ Petition has been filed against lodging of First Information Report relating to case crime no. 42 of 2009 under sections 498-A, 323, 342, 406, 504 & 506 IPC read with Section 3/4 of the Dowry Prohibition Act of Police Station Mahila Thana Sadar, district Lucknow.
We have gone through the contents of the First Information Report. Since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is accordingly dismissed.
However it is provided that if petitioners No. 1 and 3 Smt Purnima Mishra and Kumari Richa Mishra surrender before the Court below and move application for bail, they being ladies, their bail application shall be considered and disposed of expeditiously giving them the benefit of Section 437 Cr.P.C.
It is further directed that if petitioner no. 2 Birendra Kumar Mishra surrenders before the court below and moves application for bail, his bail application shall be heard and disposed of expeditiously by the Courts below.
