The petitioner was raising construction over the land which is situated within the area of Gaon Sabha but the private opposite parties have approached the Sub Divisional Magistrate, Sadar Lucknow for restraining the petitioner not to do construction over the land in question. The Sub Divisional Magistrate after adjudicating passed the order restraining the petitioner from raising any construction. Being aggrieved thereof, the petitioner has filed the instant writ petition interalia on the ground that the Sub Divisional Magistrate has no jurisdiction as the plot in question is situated within the Gaon Sabha.
The Sub Divisional Magistrate being revenue authority under the Land Revenue Act is empowered to entertain and look into the matter.
The writ petition being devoid of merit is hereby dismissed.
