From the perusal of the record, it appears that the appellant was sent to District Jail Gorakhpur on 31.01.2015. So notice be issued to appellant- Smt. Pooja @ Malti @ Babli @ Beena through the Superintendent of District Jail, Gorakhpur to send her reply as to why this appeal be not heard and disposed of finally after appointing some counsel as amicus curiae for her defence on State expenses. After receipt of the notice, if the appellant fails to engage counsel of her choice to argue this appeal on her behalf, then this Court will have no option but to appoint amicus curiae on the next date to argue the appeal on her behalf.
If the accused-appellant wishes to argue the appeal herself, she shall be produced before this court on the date fixed.
The Superintendent of District Jail Gorakhpur shall ensure the service of notice upon the appellant even if she is transferred or confined in some other jail and he shall send compliance report on or before the date fixed.
