By means of this writ petition the petitioner has come up to this Court challenging the order of the trial court dated 13.10.2014 by which it modified its earlier order dated 6.2.2012.
By order dated 6.2.2012 interim maintenance of Rs. 11,000/- (Rs. Eleven thousand) per month was granted by the court, which order has been modified by order dated 13.10.2014 to the extent that the petitioner will be entitled the aforesaid accumulated sum by the husband at the time of final decision of the suit.
The respondent-husband filed a suit under Section 13 of the Hindu Marriage Act for dissolution of marriage being Matrimonial Suit No. 150 of 2011 before the Additional District Judge, Court No.1, Mainpuri. During the pendency of the said suit the petitioner, who is the wife of respondent no.1 moved an application under Section 24 of the Hindu Marriage Act, which was allowed by order dated 6.2.2012 by issuing a direction for payment of Rs. 15000/- as cost of litigation and Rs. 5000/- for the maintenance of the wife and Rs. 3000/- each for two daughters which has been modified by the impugned order. The interim maintenance is granted to the wife during the pendency of the said suit.
The matter requires consideration.
Issue notice to respondent no.1 returnable at an early date for which learned counsel for the petitioner will take steps within a week.
The respondent may file counter affidavit within three weeks.
List thereafter.
Till the next date of listing, the operation of the impugned order dated 13.10.2014 shall remain stayed.
