Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
Parity in the matter of payment of salary to teachers of aided colleges with the teachers of normal school run by the Government was directed to be considered under the order of the Writ Court dated 18th January, 2011 passed in Civil Misc. Writ Petition No. 2702 of 2011 (Smt. Alka Pandey & others vs. State of U.P. & others) with reference to the judgment of the High Court dated 30th March, 2009 passed in Civil Misc. Writ Petition No. 10665 of 2006 (Dharampal Singh Rajpoot & others vs. State of U.P. & others).
Standing Counsel has informed the Court that an anomaly has crept into the matter of fixation of salary of Normal School Teachers inasmuch as their salary has been fixed at a higher scale vis-a-vis the Government Teachers.
Faced with the aforesaid situation, the Director (Secondary Education) has already made a reference to the State Government for removing the anomaly and the matter is under the active consideration of the State Government. He further submits that after the anomaly is removed, all such teachers shall be dealt with accordingly. (Ref. Civil Misc. Writ Petition No. 14990 of 2012; Smt. Alka Pandey and others vs. State of U.P. and others, decided on 27.03.2012).
In view of the aforesaid, the present writ petition is disposed of by providing that the State Government may take appropriate decision on the reference made by the Director (Secondary Education), preferably within two months.
All necessary action shall be taken in respect of teachers concerned including the petitioner accordingly.
