Heard learned counsel for the petitioners and the learned Standing Counsel for opposite party no.1.
Notice to opposite parties no.2 to 4 is dispensed with.
Learned counsel for the petitioners has submitted that the petitioners have filed a suit in the Court of Civil Judge (Senior Division) Faizabad for permanent injunction against defendants- respondents no. 2 to 4 from interference in their possession over the land in suit. It is also submitted that the lower court has issued notice to the defendants-caveators and despite the fact that the counter and rejoinder affidavits had been exchanged in respect of the application for interim injunction, the trial Court did not pass any order on temporary injunction application and posted the matter for 5.7.2010. It has also been contended that the petitioners are in possession over the land in dispute.
In view of the above, the trial Court (opposite party no.1) is directed to dispose of the application for interim injunction in accordance with law within ten days from 5th July, 2010.
With the above observation, this petition is finally disposed of.
