The petitioner herein seeks recounting of votes of Gram Panchayat- Husainipurwa, Block- Risiya, Pargana & Tahsil- Nanpara, District- Bahraich in respect to the panchayat elections, which have already been held and the result has also been declared, as is admitted to the petitioner's counsel.

In view of this, the relief prayed for has therefore outlived its utility. The remedy, if any, is by way an election petition under Section 12-C of the U.P. Panchayat Raj Act, 1947.

With these observations, this petition is accordingly dismissed as infructuous.
