JUDGMENT / ORDER

In title proceedings before the Consolidation Courts, the Settlement Officer, Consolidation passed an order of remand. The revision filed against the said order, was dismissed, holding that an order of remand is an interlocutory order and, therefore the revision itself is not maintainable.
It is submitted by the learned counsel for the petitioner that this reasoning is illegal inasmuch as it has been settled that an order of remand is not an interlocutory order.
Matter requires consideration.
Shri Avinish Kumar holding brief of Shri K.K. Pandey, learned counsel for the respondent prays for and is granted two weeks time to file counter affidavit.
Two weeks time thereafter is granted to the learned counsel for the petitioner for rejoinder affidavit.
List immediately after the expiry of the aforesaid period.
Until further orders, the operation of the impugned order dated 31.5.2013 shall remain stayed.
