Learned counsel for the petitioner contends that under the guidelines/policy adopted by the respondents, option for place of transfer had to be taken from a handicapped teacher and female teacher. Needful has not been done and yet the petitioner has been transferred to a place, twenty kilometres away, however, within the same block vide Annexure-1, dated 31.7.2012.

Issue notice to respondent no.2, returnable in two weeks.

Sri Ajay Verma, Advocate has put in appearance for respondent no.3 and Respondent no.1 would be represented by the Government Counsel.

Because the order of transfer was actuated in July, 2012, there would be no stay on operation of impugned order.
