Smt. Mazda Begam vs State Of U.P.And Another

High Court Of Judicature at Allahabad|27 January, 2010

JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. for the State respondent.
The present 482, Cr.P.C. application has been filed for quashing the order dated 2.2.2005 passed by Chief Metropolitan Magistrate, Kanpur Nagar in case crime no. 503 of 2003 under Section 498-A, 304-B IPC and Section 3/4 Dowry Prohibition Act, whereby the concerned Magistrate has rejected the final report and directed for reinvestigation in the matter as well as for quashing the revisional court's order dated 21.8.2009.
It is contended by the learned counsel for the applicant that instead of reinvestigation, further investigation should have been directed.
It is contended by the learned A.G.A. that there is no illegality in the order impugned by which reinvestigation was directed and its wrong nomenclature should be of no consequence and, in fact, it is an order directing further investigation, as the offence is under Section 498-A and 304-B IPC, and thus there is nothing, which may warrant any interference by this Court in exercise of power under Section 482, Cr.P.C.
After hearing the learned counsel for the parties, in the opinion of this Court, no interference is warranted in the order impugned.
The application lacks merit and is, accordingly, dismissed.
