JUDGMENT / ORDER

One month time was granted to file counter affidavit on 7.9.2010. On the request of learned Standing Counsel one month further time was allowed on 8.10.2010. On 12.11.2010 one month and no more was allowed to file counter affidavit. Despite the stop order, counter affidavit has not been filed. On 15.12.2010, as a last opportunity, four weeks further time was allowed to file counter affidavit. Till date counter affidavit has not been filed. He prayed four weeks further time to file counter affidavit. On the last occasion it was made clear that in case if counter affidavit would not be filed, the time would be granted only on the costs of Rs.5,000/-.
In view of the above, four weeks further time is allowed to file counter affidavit on payment of costs of Rs.5,000/-to the petitioner.
List this case after four weeks. Till the next date of listing, interim order shall continue provided the condition of the interim order granted earlier has been complied with.
A certified copy of this order may be provided to Sri Nimai Das, learned Standing Counsel.
