JUDGMENT / ORDER

This is a petition by the landlord.
The release application under Section 21 of U.P. Act No.13/72 of the landlord was allowed by the prescribed authority. Against the said order the respondent-tenant has preferred an appeal which has been admitted and 28.10.2010 has been fixed.
Challenging the aforesaid order petitioner has filed the present writ petition contending that the appeal was not liable to be admitted in view of the findings of the prescribed authority and that at least certain conditions directing for the deposit of the rent as claimed by the petitioner ought to have issued.
The appeal is a statutory appeal as provided under Section 22 of the Act. The order admitting the appeal is of an interlocutory in nature and requires no interference when the appeal is already fixed for 28.10.10.
In view of above, I decline to interfere in the matter, the writ petition is dismissed with the observation that the lower appellate court to take care to decide the appeal as expeditiously as possible preferably within a period of 6 months from the date of production of the certified copy of this order.
