JUDGMENT / ORDER

Sri Manish Kumar, learned counsel appearing for opposite party no.1, on the basis of instructions, submitted that in pursuance to the provisions of Section 174 of the Motor Vehicles Act, 1988, the Motor Accident Claims Tribunal, on an application made by a person entitled to the amount due under the Award, from a person, is only required to issue certificate/letter of the said amount to the Collector and the Collector in its turn is to proceed to recover the said amount, in the same manner, as arrears of land revenue but despite issuing three reminders namely; dated 06.01.2010, 12.07.2010 and 09.11.2010, for executing the Award passed by Motor Accident Claims Tribunal, no steps have been taken at the end of the Collector.
Learned standing counsel is directed to seek instructions in the matter and to clarify as to what action has been taken by the Collector pursuant to the recovery certificate/letter issued by the Motor Accident Claims Tribunal in CMC No. 33 of 2007 arising out of MACT No. 14 of 2005 (Smt. Malti Devi and others vs. General Manager, UPSRTC, Head Office Lucknow), in terms of the judgment and Award dated 02.11.2013.
