The present wit petition has been filed for issuance of a direction to the opposite party no.1 i.e. Naib Tehsildar, Magraura, Tehsil-Patti, District-Pratapgarh to decide the application for mutation of the petitioner registered as Case Crime No.407 of 2019 (Smt. Mala Singh Vs. Lal Pratap Singh), Computerized Case No.T-01902570400926.
The submission of the learned counsel for the petitioner is that the petitioner purchased the agricultural land bearing Gata No.84/0.790 hect. situated in Village-Marha, Pargana and Tehsil-Patti, District-Pratapgarh from the opposite party no.2 and thereafter, the petitioner moved an application for mutation under Section 34 of the U.P. Land Revenue Code on 20.02.2019 and the same is pending for disposal. The statutory period of deciding the application for mutation under Section 34(7) is 90 days which has already been expired and the same has not been disposed of. Accordingly, the prayer is to dispose of the application for mutation.
To the prayer made by learned counsel for the petitioner, learned counsel for the opposite party no. 1 has no serious objection.
Considering the facts and circumstances of the present case, the writ petition is disposed of with a direction to the opposite party no.1 i.e. Naib Tehsildar, Magraura, Tehsil-Patti, District-Pratapgarh to decide the application for mutation of the petitioner registered as Case Crime No.407 of 2019 (Smt. Mala Singh Vs. Lal Pratap Singh), Computerized Case No.T-01902570400926, expeditiously say within a period of six months, if possible, from the date of production of certified copy of this order.
