Heard learned counsel for the applicants and learned AGA for the State.
Learned counsel for the applicant states that it is a matrimonial dispute and prays that the matter may be referred to the Mediation Centre.
It is directed that the applicants shall deposit a sum of Rs. 7,000/- within a period of three weeks from today with Mediation and Conciliation Centre. Out of the amount so deposited, opposite party no. 2 shall be given Rs. 5000/- for her to and fro journey and Rs. 2000/- be deposited with the Mediation Centre.
Let this order be placed before the Registrar/ in-charge of ' Allahabad High Court Mediation and Conciliation Centre'. The Registrar/ in charge of the Mediation Centre, shall fix a date and every efforts shall be made for re- conciliation and complete the process of mediation within three months from today. In the event, the effort is not successful, the case will be listed after three months, along with report of conciliator.
Till the next date of listing, further proceedings of order dated 16.3.2010 passed by the Additional Chief Judicial Magistrate, Court No. 6, Aligarh in Application No. 1169 of 2009 (Smt. Nagma Vs. Vilal and others), under Section 498A and 406 IPC, pending in the Court of Addl. Chief Judicial Magistrate, 6th shall remain stayed provided the applicants appear on each and every day before the Mediation Centre without fail and also pays Rs. 2000/- on each date to opposite party no. 2 for her to and fro journey.
In the event of default, this interim order shall stand automatically vacated.
