Heard Sri M.P.Yadav, learned counsel for the applicant.
It is stated that in spite of the order of this Court dated 14.3.2012 restraining the parties not to enter into fresh marriage during the pendency of the appeal the opposite party has solemnised marriage with Ms. Pooja Sharma. It is stated in paragraph 4 of the affidavit filed in support of the application that the opposite party has made Ms. Pooja Sharma as his nominee in the service book in utter violation of the order of this Court dated 14.3.2012 and his conduct falls under the purview of Order 39 Rule 2(a) of the Code of Civil Procedure.
Prima facie, a case for willful disobedience of the order of this Court dated 14.3.2014 has been made out.
Issue notice to the opposite party. On that that the opposite party shall remain present before the Court showing cause as to why charge be not framed for punishing him for willful disobedience of the order 14.3.2014 passed by this Court List on the date mentioned in the notice.
