This petition has been registered on the basis of a letter petition said to have been sent by one Lakshmi Devi with the allegation that she has married one Sushil Kumar of her own free will and choice, as such her parents, who were against the marriage with the aid of Police personnel have taken into custody her brother-in-law Dashrath and the police personnel of Police Station Bighapur are demanding amount to release said Dasrath.
Counter affidavit on behalf of the State has been filed by Shri A.K.Shukla, Superintendent of Police, District Unnao whereby allegations are denied and it has been stated that at no point of time, Dashrath was ever arrested nor he is wanted in any case by the police of Police Station, Bighapur. It has further been stated that Dashrath is residing at Telibagh, Lucknow alongwith his uncle freely without any hindrance.
Due to what has been stated in the uncontroverted counter affidavit filed by the State, this Habeas Corpus writ petition is misconceived and is accordingly dismissed.
