JUDGMENT / ORDER

Sri Darwari Lal has filed Vakalatnama on behalf of the applicant is taken on record.
Heard learned counsel for the applicant and learned A.G.A.
Learned A.G.A. has accepted notice on behalf of opposite party no. 1.
Issue notice to opposite party no. 2 returnable at an early date.
Four weeks time is granted to opposite party no. 2 as well as learned A.G.A. to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.
List thereafter.
After hearing learned counsel for the applicants and also in view of the averments made in the affidavit accompanying the application under Section 482 Cr.P.C., prima facie, a case for grant of an interim relief is made out.
Until further orders of this Court, further proceedings of Case No. 398 of 2013, Case Crime No. 536 of 213, under Section 309 I.P.C., P.S. Sirauli, District Bareilly pending in the court of Judicial Magistrate 2nd Awala, Bareilly shall remain stayed as against the applicant.
