Smt. Komal Sharma vs State Of U.P. Thru Secy. And 3 ...

High Court Of Judicature at Allahabad|11 March, 2014

JUDGMENT / ORDER

Admittedly, the Saw Mill license was not renewed in favour of the husband of the petitioner after 1992 and was transferred in the name of the third and fourth respondents. The petitioner has now filed a writ petition in 2014 nearly 22 years thereafter seeking a direction that the Saw Mill license should be transferred in her name.
No such relief can be granted in a hopelessly belated petition. Learned counsel states that the information under the Right to Information Act was supplied to the petitioner in June 2012. This would not detract from the gross delay since it is clear that the petitioner made an application under the Right to Information Act, 2005 only in June 2009. The delay is unexplained. Hence, we decline to interfere.
The writ petition is, accordingly, dismissed.
