The petitioner has filed Original Suit No. 531 of 2009 (Smt. Kanta Rani Vs. Smt. Ramwati and others on 1.10.2009 pending in the Court of Civil Judge (J.D) Etah and this fact was neither disclosed in the present writ petition nor it was disclosed in the earlier Writ Petition No. 57934 of 2009 (Smt. Kanta Rani Vs. State of U.P. and others) in the month of November 2009.
It is open to the petitioner to seek his relief in the suit.
Accordingly, this petition is dismissed.
