The contention of the petitioner is that a suit has been filed by the respondent for the cancellation of the sale deed. The name of the plaintiff-respondent is not recorded in the revenue court and the nature of the land is agricultural land therefore the suit was not maintainable.
Respondent is represented by Sri Kameshwar Singh, Advocate. He prays for and is granted three weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
