JUDGMENT / ORDER

Heard Sri S.K Purwar, learned counsel for the appellant and Sri M. Jain, learned counsel for the respondent no.1. No one has appeared for the heirs and legal representatives of the deceased respondent no.2.
On the substitution application filed in respect of respondent no.2, notices sent to the heirs and legal representatives by registered post are deemed to be served in view of the office report dated 26.8.08. Since there is no opposition by filing any counter affidavit. Substitution application is allowed.
Let the names of heirs and legal representiaves of the deceased respondents be substituted as respondent nos. 2/1 to 2/7.
