Heard Sri Ajay Kumar Mishra for the petitioner. The writ petition has been filed for mandamus directing the opposite party nos. 1 and 2 to decide the objection of the petitioner dated dated 3.9.2012 filed before the Assistant Consolidation Officer.
The petitioner has filed a questionnaire showing that the village was placed under the consolidation operation by order dated 20.03.2010. Although partal has been done but the proceeding under Section 8A of U.P. Consolidation of Holdings Act, 1953 has not been completed. It is not clear whether notification under Section 9 of the Act has taken place or not. In such circumstances, so long as notification under Section 9 of the Act is not issued, no right accrues to the petitioner for filing objection.
The writ petition is misconceived and it is dismissed.
