The petitioner has been appointed as Mini Aaganwadi Karyakatri for the Gram Sabha Ballia Kalan. Her appointment has been cancelled by the impugned order dated 9.5.2011 on the ground that on an inquiry, the Gram Pradhan in his report dated 4.1.2011 informed that the petitioner is resident of Gram Kushmha of Gram Sabha Ballia Kalan and in this regard a notice has been issued which has not been replied. In the impugned order itself it is mentioned that the petitioner was appointed as Mini Aaganwadi Karyakatri for Gram Sabha Ballia Kalan. It is not the case of the Bal Vikas Pariyojna Adhikari, Chakia, District Chandauli that she is not resident of Gram Sabha Ballia Kalan. The Gram Pradhan in his report itself stated that she is resident of Gram Kushmha which falls under the Gram Sabha Ballia Kalan. Therefore, the cancellation of the appointment on the aforesaid ground appears to be unjustified.
Learned Standing Counsel may file counter affidavit within a period of four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the operation of the order dated 9.5.2011 passed by the Bal Vikas Pariyojna Adhikari, Chakia, District Chandauli, Annexure-6 to the writ petition, shall remain stayed.
