JUDGMENT / ORDER

Heard, Shri P.K Upadhyay, learned counsel for the petitioner and Shri Pankaj Srivastava, learned Additional Chief Standing Counsel.
This petition has been filed by the petitioner for a direction to the opposite party to consider the petitioner for the post of Anganwadi Karyakatri for Anganwari Center, Jyotipur Samaisa, District- Ambedkar Nagar as provided in Column No.3 of G.O. dated 29.01.2021 contained in annexure no.3 to the writ petition.
The sole argument advanced by the learned counsel for the petitioner is that under Column No.3 of the G.O. dated 29.01.2021 only the Assistant Anganwari Karyakatri of the Gram Sabha concerned can apply for the post of Karyakatri but the post in question has been reserved only for the Scheduled Caste as advertised by means of the advertisement dated 26.03.2021 therefore the petitioner is not able to apply while the petitioner is the only eligible candidate in the Gram Sabha concerned as the petitioner is working on the post of Assistant Anganwari Karyakatri w.e.f. 22.05.2008 and she has been given charge of Anganwari Karyakatri w.e.f. 29.01.2020.
The contention of the learned counsel for the petitioner seems to be misconceived because it has been provided in Column No.3 that first of all such candidate shall be considered and in sub-paragraph of paragraph-1 it has been mentioned that it shall be seen that the reservation is not effected in any manner and the post has been advertised for the post of Scheduled Caste but the advertisement has not been challenged and it has not been shown that the reservation has been violated in any manner.
At this state, learned counsel for the petitioner submitted that the writ petition may be dismissed as not pressed with liberty to file fresh with proper pleadings and prayer. To which there is no objection by the learned Additional Chief Standing Counsel.
In view of above, the writ petition is dismissed as not pressed with liberty to file fresh, if so advised.
