Sri Ratan Singh, Advocate, has filed Vakalatnama today on behalf of respondent no. 7, which is taken on record.
Compliance report on behalf of the State has also been filed. Counter affidavit on behalf of respondent no. 7 has also been filed.
Impleadment application by Smt. Sandhya is filed alongwith Vakalatnama of Sri Amit Srivastava, Advocate, in which it has been stated that she is legally wedded wife of Manish Kumar and she should be impleaded as party for proper adjudication of the matter. Corpus is not present today. Respondent no. 6 is also served personally, as per compliance report / office report, but she is not present personally today before the Court. Respondent no. 6 is mother of the corpus.
It is submitted by learned counsel for the respondent no. 7 that corpus is legally married wife of respondent no. 7, this habeas corpus writ petition has been moved on wrong assertion on facts.
The petitioner is directed to file rejoinder affidavit in response to impleadment application and to explain his position.
As per counsel for respondent no. 7, the corpus is at present with her-in-laws and not with respondent no. 6, so she is unable to produce the corpus before the Court. Respondent no. 6 is served, but she is not appeared.
Let a bailable warrant be issued against the respondent no. 6.
C.J.M. concerned is directed to get the bailable warrant executed, in case bonds are being filed by respondent no. 6 then she will be set at liberty with a undertaking that she will remain present before the Court alongwith the corpus on date fixed.
As per compliance report filed by the State, the corpus is married to respondent no. 7.
Copy of this order be provided to learned A.G.A for the State for compliance of the order and for production of the corpus before the Court, so as to elucidate all the facts that are required/relevant for further proceedings of the case.
