Notices to opposite parties no.2 and 3 are dispensed with. The order passed by the Civil Judge on temporary injunction application moved under Order 39 Rule 1 and 2 C.P.C. has been challenged in this writ petition. The said order is appellable under Order XLIII Rule 1 (r) C.P.C. In view of availability of the alternative statutory remedy of appeal against the impugned order, this writ petition is not maintainable. The writ petition is, accordingly, dismissed.
