Dr. P.K. Maheshwari appeared today in person, filed an affidavit and explained the reason for non-appearance on 12.7.2011 and tendered his unconditional apology for non-appearance.
In view of the explanation given by him, an unconditional apology is accepted. In paragraph-10 of the affidavit, it is further stated that on 13.7.2011 through Special Messenger the amount of gratuity has been released. The copy of the letter dated 13.7.2011 is Annexure-2 to the affidavit. The letter reveals that in stead of Rs.3,50,115/-, the amount which has been detained by the respondent on account of non-payment of the loan, only a sum of Rs.2,87,760/- has been released.
The respondent is directed to explain that why the balance amount has not been released. He may also explain that why the Department may not be liable for the loss suffered by the petitioner on account of non-release of the payment within the due period.
List this case on 1.8.2011. On that date, Dr. P.K. Maheshwari is not required to present in person.
