Heard Sri Shailesh Kumar Srivastava, learned Counsel for the petitioners and Sri S.P. Singh, learned AGA for the State/respondents no. 1 and 2.
This writ petition has been filed by the petitioners, Smt. Basanti Gupta, Shakti Gupta, Km. Naina Gupta, Smt. Lalita Gupta, Smt. Pinki Gupta, seeking to quash the First Information Report registered as Case Crime No. 0326 of 2020, under Sections 498A, 323, 504, 506, 313, 377 I.P.C. & Section 3/4 of Dowry Prohibition Act, Police Station Chowk, District Lucknow.
Vide order dated 19.10.2020, a Co-ordinate Bench of this Court stayed the arrest of the petitioners in the aforesaid case till the next date of listing or filing of the police report under Section 173 (2) of the Code of Criminal Procedure, whichever is earlier.
Learned Counsel for the petitioner submits that the matter has been referred to the Mediation Centre at district level and the same is pending.
Learned AGA does not dispute the aforesaid facts.
Considering the facts and circumstances of the case, the concerned authority of the Mediation Centre at district level is directed to conclude the mediation process between the parties within a period of two months from the date of receipt of a certified copy of this order, if the same has not already been concluded.
Till the conclusion of the mediation process, no coercive action shall be taken against the petitioners in pursuance of the aforesaid case.
With the aforesaid, the writ petition stands disposed of.
