Heard learned counsel for the petitioners and the learned Additional Government Advocate.
By means of this writ petition, petitioner no. 2 who happens to be an accused of Case Crime No.33 of 2010 under Sections 366/506 I.P.C., Police Station Unchachaar, District Rae Bareli has approached this court stating that he had married with petitioner no.1, who is major and as per Annexure No.1, her date of birth is 25.11.1989.
Submission of learned counsel for the petitioners is that the petitioners are major and they have entered into marriage out of their own free will. He stated that in view of the judgment in the case of Lata Singh Vs. State of U.P. : (2006) 5 SCC 475, the petitioners have got every right to marry a person of their own choice. He submitted that respondents nos.4 to 7 with the aid of respondents nos.1 to 3 are in search of the petitioners and it is feared that they may eliminate the petitioners for the sake of honour killing.
Learned counsel for the petitioners submits that in view of the aforesaid, it is the duty of this Court to protect the life and liberty of the petitioners.
In the aforesaid circumstances, we hereby direct that notices be issued to the respondents nos.4 to 7 returnable at an early date.
List after receipt of notice.
Till the next date of listing, the petitioners shall not be arrested in the aforesaid case crime subject to their cooperation with the investigation, which shall go on.
