Heard Sri B.Q. Siddiqui, learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Dipak Seth, learned counsel for the opposite party No.2.
By means of this writ petition, the petitioner has prayed for the following relief:-
"(a) to issue a writ, order or direction in the nature of mandamus directing the opposite parties / opposite party No.2 to consider and decide the claim of the petitioner with regard to the grant of family pension in view of the recommendation of the Superintendent of Police Kheri, contained as Annexure No.6 to the writ petition within stipulated time and communicate the decision to the petitioner."
Today, the learned Standing Counsel has produced the letter of instructions dated 10.08.2021 preferred by the Finance Controller, U.P. Police Headquarter addressing to the Chief Standing Counsel of this Court annexing therewith a letter dated 08.08.2021 preferred by the Superintendent of Police, District-Kheri to the Finance Controller, U.P. Police Headquarter, Lucknow and the letter dated 07.08.2021 preferred by the Superintendent of Police, District-Kheri to the petitioner.
By means of letter dated 08.08.2021 preferred by the Superintendent of Police, District-Kheri to the Finance Controller, U.P. Police Headquarter, Lucknow, nine informations are required from the petitioner and as per learned counsel for the petitioner the petitioner has made available seven informations before the Competent Authority. Only two informations are required to be provided, those are the relevant documents showing the petitioner is a divorced lady and she is unemployed. Both the aforesaid documents shall be certified from the department. Copy of one more letter has been produced before this Court which is dated 28.02.2020 preferred by the Accountant General, Allahabad to the Finance Controller whereby 11 informations have been sought. As per learned counsel for the petitioner except two informations, all the informations have been made available to the Competent Authority. Two informations are relating to the divorce certificate duly certified by the department and unemployment certificate duly certified by the department are to be produced before the Competent Authority.
Be that as it may, since the required informations have been made available to the concerning authorities except two documents, one is divorce certificate and the second is unemployment certificate, the petitioner shall provide these documents to the department at the earliest after getting the same certified from the department.
It is needless to say that the Sub-Divisional Magistrate/ Tehsildar concerned shall also do needful if the petitioner approaches such authorities for getting the aforesaid certificates. As soon as the required formalities are completed by the petitioner, the family pension shall be paid to the petitioner strictly in accordance with law with expedition preferably within a period of two months.
In view of the aforesaid observations and directions, the instant writ petition is disposed of finally.
