Heard learned counsel for the petitioner, learned State Counsel for Opposite Party Nos.1,2,3 and 4 and Sri Ajay Kumar, learned counsel for Opposite Party No.5.
The present writ petition has been preferred for issuing direction to the Opposite Party No.3 i.e. District Basic Education Officer, Faizabad to adjust the petitioner in any school of block Bikapur wherein husband of petitioner is working as Assistant Teacher in Intermediate College. It has further been prayed for commanding and directing the Opposite party No.3 to adjust the petitioner in any school of reasonable distance, if possible within radius of 25-30 km from home of her husband and lastly a prayer has been made to direct the Opposite party No.2, the Secretary, U.P. Basic Education Board, Prayagraj to consider and decide the representation of petitioner dated 19.03.2021.
Learned counsel for the petitioner has submitted that the petitioner has been transferred 80 km away from the place of posting of the husband of the petitioner, who is also an Assistant Teacher in Government Inter College. The petitioner has also made representation but the authorities are not taking any decision on it.
On the other hand, learned counsel for the respondents have submitted that the petitioner was transferred from District - Barabanki to District Faizabad as Assistant Teacher in Block Bikapur vide order dated 13.06.2018 and vide placement order dated 7.7.2018 issued by Opposite Party No.3 i.e. District Basic Education Officer, Faizabad, the petitioner was posted at U.P.S. Pure Badrai, Block Mawai, District - Faizabad, but till date the petitioner has not joined.
In reply thereto, learned counsel for the petitioner has submitted that the petitioner is making representations continuously to the authorities concerned but no decision has been taken. It has further been submitted that the petitioner was transferred at District - Faizabad from District - Barabanki looking to the posting of the husband of the petitioner at Faizabad and now the posting of the petitioner at the distance of 80 KM from the place of posting of husband of the petitioner frustrates the very purpose of transferring the petitioner from District Barabanki to District - Faizabad.
At this stage, learned counsel for the petitioner has confined his prayer to the extent that the Opposite Party No.3 may be directed to decide the representation of the petitioner dated 19.03.2021.
Without entering into the merit of the case and with the consent of the learned counsel for the parties, the Opposite Party No.3 District Basic Education Officer, Faizabad is directed to decide the representation dated 19.03.2021 of the petitioner by passing a speaking and reasoned order within a period of two months from the date of a copy of this order downloaded from the official website of the High Court is served.
With this observation, the writ petition is disposed off.
