Ref: Civil Misc. Modification Application No. 72356 of 2012 By the order dated 13.12.2011, the transfer application was allowed transferring the Divorce Petition No. 179 of 2011 from district Farrukhabad to Kanpur Nagar.
This is an application for modification of the aforesaid order filed on behalf of husband stating that there is another litigation between the parties relating to restitution of conjugal right being Case No. 136 of 2011 pending in the court of Civil Judge (Sr. Div.) Firozabad. The modification has been sought so that the said petition for restitution of conjugal right be also transferred to Kanpur Nagar.
Having heard the learned counsel for the parties, I do not find any good ground for modification of the order dated 13.12.2011. There being no error in the order dated 13.12.2011, no case for modification has been made out. However, it shall be open for the husband to file fresh transfer application and if such an application is filed, this order shall not come in the way of the parties.
The modification application is disposed of.
