Corpus is only four years of age and for that age mother and respondent no. 2 is entitled for the custody of the corpus and at this juncture it is submitted by learned counsel for the petitioner that a meeting right with the daughter be provided to the petitioner once in a month for a short period. Respondent no. 2 has stated he is no objection regarding that although she stated that after more than one and half years petitioner has taken notice of his daughter.
Petitioner is father of the corpus and certainly he is having right to meet his daughter and that can be accorded, accordingly as per agreement between the parties, it is ordered that on last Sunday of every month the corpus will be handed over to the husband / petitioner. The petitioner will take custody of the corpus from the parental house of respondent no. 2 and he will return the corpus at 4:00 p.m. on the same day. During the course no charge / allegation will be made against each other and they will handle the corpus in peaceful manner.
A bank draft of Rs. 15,000/- that was deposited as per courts order will be handed over to the respondent no. 2 today itself.
The petition is disposed off accordingly.
