With reference to our order dated 7.1.2014, the Principal Secretary, Labour Department, U.P. Shasan, Lucknow has filed an affidavit categorically stating that the case of the husband of the petitioner for regularisation does fall within the four corners of the U.P.Regularisation of Ad-hoc Appointments (On posts within the purview of the Public Service Commission (Third Amendment) Rules, 2001 and that the matter in that regard including payment of post retiral dues is under reconsideration.One month's time has been prayed for the purpose.
In view of the aforesaid, the writ petition is disposed of finally with a direction that the respondent no.2 shall consider and decide the matter preferably on or before 28.2.2014 by means of a reasoned order. The decision shall be communicated to the petitioner and all consequential measure shall be taken immediately thereafter. The order impugned in the present writ petition dated 4.4.2013 shall abide by the decision to be taken by the respondent no.1, as indicated above.
