Heard learned counsel for the petitioners and learned AGA for the State.
It is undisputed that the husband of petitioner no. 1 is implicated in a criminal case of which an FIR has been registered under Section 363 IPC and Section 3(2)(V) of SC/ST Act. In these circumstances it is clear that the police authorities during the course of investigation have to trace out the accused at all the probable places including the residence where the petitioners are also stated to be residing.
The prayer that the petitioners may not be harassed in furtherance of the FIR lodged against a family member, is wholly misplaced unless a specific grievance for the relief sought is averred and made out.
The police authorities are at liberty to go ahead with the investigation. The petitioners are equally duty bound to cooperate with the investigation by disclosing the whereabouts of the accused as per their knowledge and belief.
It is expected that the police authorities shall act strictly in accordance with law and with this observation the writ petition is disposed of finally.
