The petitioner is before this Court for a direction to Civil Judge (S.D.), Kanpur Nagar, to decide the application of the petitioner filed under Order 39 Rule 1 and 2 read with Section 151 C.P.C. (Paper No.6C2) filed in Original Suit No.69 of 2021 (Asha Tiwari Vs. Cantonment Board) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of two months, thereafter.
