This writ petition is filed seeking a direction to impound the Passport of the 5th respondent. It appears that the petitioner is the wife of the 5th respondent. The 5th respondent is involved in a criminal case, which was numbered as C.C.No.468/2009 on the file of the Judicial First Class Magistrate Court, Thrissur. On account of this, the petitioner seeks to impound the Passport of the petitioner. This Court cannot pass such an order in a writ petition under Article 226 of the Constitution of India. If any competent court where criminal case is pending, pass such an order, it is open to the Passport Authorities to act upon such direction.
Accordingly, this writ petition is disposed with liberty to the petitioner to approach the appropriate forum.
