Heard Sri Alok Dwivedi, learned counsel for the petitioner and Sri Ghaynendra Srivastava, learned counsel for the respondents no.1 to 4 and 7.
The petitioner has preferred the present writ petition with the prayer to quash the letter dated 24.5.2019 passed by the respondent no.3/Joint Director of Education, Kanpur Region, Kanpur as well as order dated 25.5.2019 passed by the respondent no.4/District Inspector of School-II, Kanpur Nagar, (annexure nos.7 and 8 to the writ petition) with further prayer to issue writ of mandamus commanding the respondent no.3 and 4 to forward/send the application of the petitioner before the respondent no.2/7 for transfer from respondent no.5 institution to the respondent no.6 institution and further direct the respondent no.2/7 to consider the transfer from the respondent no.5 institution namely Kaushalya Devi Girls Inter College, Kidwai Nagar, Kanpur Nagar to the respondent no.6 institution namely Kanpur Vidya Mandir, Mahila Inter College, Swaroop Nagar, Kanpur Nagar on the post of L.T. Grade Teacher Science/Maths after calling the application of transfer of the petitioner from the respondent no.3 and 4.
The facts in brief as contained in the writ petition are that the petitioner was initially appointed on the post of Assistant Teacher in attached primary section of the institution namely Kaushalya Devi Girls Inter College, Kidwai Nagar, Kanpur Nagar in the year 2000. Subsequently, the petitioner was promotted on the post of Assistant Teacher in L.T. Grade and the aforesaid promotion of the petitioner was approved by the D.I.O.S., Kanpur Nagar vide its order dated 18.10.2014.
It is contended by learned counsel for the petitioner that the aforesaid order of approval for promotion was cancelled by Director of Education vide its order dated 14.12.2017.
Against the said order the petitioner preferred a writ petition being Writ A No.62073 of 2017 (Smt. Samit Tiwari Vs. State of U.P. and 4 ors.) and in the said writ petition the order of status quo was granted to the petitioner by this Court and the effect and operation of the order dated 14.12.2017 passed by the Director (Secondary Education) Lucknow was kept in abeyance. Further directions were given by this Court to make the payment of salary to the petitioner as and when due. The aforesaid writ petition is still pending.
As per Regulation 55 to 61 contained under Chapter 3 of the U.P. Intermediate Education Act, 1921, the petitioner has submitted an application for her inter district transfer from the institution respondent no.5 to respondent no.6. The Principal and Management of both the institutions were duly granted no objection certificate in favour of the petitioner. Subsequently D.I.O.S. -II Kanpur Nagar vide its letter dated 6.5.2019 submitted an application for transfer of the petitioner before the respondent no.3/Joint Director of Education, Kanpur Region, Kanpur as required under Regulation 58 of Chapter 3 of the Act, 1921. Certain information were sought by the respondent no.3 from the respondent no.4 vide its letter dated 15.5.2019. The reply was given by the respondent no.4 vide its letter dated 17.5.2019. Subsequently respondent no.3 wrote a letter dated 24.5.2019 by which objections were raised for the transfer of the petitioner. Pursuant to the same, the respondent no.4 wrote a letter dated 25.5.2019 to the respondent no.5 by which he return the paper of the transfer of the petitioner.
In view of the letter dated 24.5.2019 written by the Joint Director of Education, Kanpur Region, Kanpur/respondent no.3 it was argued by Sri Dwivedi, learned counsel for the petitioner that the aforesaid order passed by the respondent no.3 is absolutely arbitrary and illegal.
He contended that the Joint Director of Education has no authority to reject the claim but he is the authority in law only to endorse the application of transfer of the candidates and the ultimate decision will be taken by the Director of Education. Learned counsel for the petitioner relied upon the Regulation 59(1) of the Act as amended on 16.5.2018 and Regulation 59(1) to (4) contained under Chapter 3 of the U.P. Intermediate Education Act, 1921. The amended provisions in this regard is reproduced below :-
“59-(1) िविनिनियम 58 के अधीनि िनिरीक्षक द्वारा अग्रसािरत आविनेदनि पत्र की प्रािप पर मण्डलीय संयक्त िनिदेशक इस प्रयोजनि के िलए रखे गये रिजस्टर मे इसे दजर करगा और आविनेदनि पत्र को िशक्षा िनिदेशालय उत्तर प्रदेश को प्रेिषित करगा।
(2) उक्त प्राप आविनेदनि पत्रो को िनिदेशालय द्वारा इस हेतु संरिक्षत रिजस्टर से अंिकत िकया जायेगा।
(3) प्रधानि / अध्यापक द्वारा िजस संस्था मे स्थानिान्तरण चाहा गया है, उससे सम्बन्धित न्धत िजला िविनद्यालय िनिरीक्षक से पद िरक्त होनिे, अिधयािचत नि होनिे तथा शासनिादेश िदनिांक 20.11.1976 के मानिकानिुसार आविनश्यकता होनिे की पिु ष करायेगा। उक्त कायरविनाही 30 मई के पूर्विनर पणर करा ली जायेगी।
(4) पद िरक्त होनिे, अिधयािचत नि होनिे तथा शासनिादेश िदनिांक 20.11.1976 के मानिकानिुसार आविनश्यकता होनिे की पिु ष होनिे पर िनिदेशालय द्वारा प्रस्तुत करगा। (तीनि) िनिम्नििलिखत द्वारा गिठित सिमित की संस्तुितयों पर स्थानिान्तरण आदेश जारी करगा। क- सम्भागीय संयक्त िशक्षा िनिदेशक- अध्यक्ष ख- सम्भागीय उप िशक्षा िनिदेशक (मा0)- सदस्य ग- सम्भागीय सहायक िशक्षा िनिदेशक- सदस्य (बन्धेिसक) (कक) प्रिशिक्षत स्निातक (एल.टी.) श्रेणी के अध्यापक के िकसी आविनेदनि पत्र क मामले मे यिद स्थानिान्तरण सम्भाग के बन्धाहर चाहा गया है, सम्भागीय संयक्तु िनिदेशक आविनेदनि पत्र को अपर िशक्षा िनिदेशक (माध्यिमक) को अग्रसािरत करग िशक्षा ा। (ख) प्रविनक्ता श्रेणी मे िकसी अध्यापक या िकसी संस्था के प्रधानि के आविनेदनि पत्र क मामले मे-
(एक) आविनेदनि पत्र को अपर िशक्षा िनिदेशक (माध्यिमक) को अग्रसािरत करग स्थानिान्तरण िकसी अन्य सम्भाग मे ित स्थित संस्था मे चाहा गया हो। ा, यिद (दो) यिद संस्था सम्भाग के भीतर ित स्थत हो तो सम्बन्धित न्धत िनिरीक्षक के माध्यम से संस्था के प्रबन्धन्धतन्त्र से परामशर करगा, िजसमे स्थानिान्तरण चाहा गया हो और ऐसी संस्था की िलिखत सहमित प्राप होनिे पर आविनेदनि पत्र को अपर िशक्षा िनिदेशक (माध्यिमक) को अग्रसािरत करगा। (2) उप िविनिनियम (1) के उपखण्ड (कक) और (ख) के अधीनि आविनेदनि पत्र प्राप होनिे पर अपर िशक्षा िनिदेशक (माध्यिमक) इस प्रयोजनि के िलए रखे गये रिजस्टर म रिजस्टर ीकृ त करविनायेगा और (क) यिद संस्था की सहमित िजसमे स्थानिान्तरण चाहा गया है उपलब्ध है तो उप खण्ड (ग) के अधीनि गिठित की गयी सिमित के समक्ष आविनेदनि पत्र प्रस्तुत करगा। (ख) यिद विनह संस्था िजसमे स्थानिान्तरण चाहा गया है िकसी अन्य सम्भाग मे ित स्थत है तो सम्बन्धित न्धत उप अपर िशक्षा िनिदेशक (माध्यिमक ) के हस्ताक्षर से स्थानिान्तरण आदेश िनिगरत िकया जायेगा। उक्त स्थानिान्तरण आदेश 30 मई से 30 जूर्नि के मध्य िनिित श्चत रुप से िनिगरत कर िदये जायेगे। समस्त स्थानिान्तरण 30 मई से 30 जूर्नि (ग्रीष्म अविनकाश) के मध्य िकए जायेगे। इस अविनिध के अितिरक्त अन्य िकसी अविनिध मे कोई स्थानिान्तरण निहीं िकया जा सके गा।"
It is contended that in violation of the aforesaid provisions papers for transfer of the petitioner was returned by the respondent no.3. In this regard the petitioner also submitted a representation addressed to the competent court namely Director of Education (Secondary) Lucknow on 25.5.2019, copy of which is appended as annexure 10 to the writ petition. It is further contended that till date no decision has been taken on the said representation.
Learned counsel for the petitioner further contended that matter is urgent because as per the policy of the Government the transfer orders could only be made from 30.5 to 30.6 of the year.
In the facts and circumstances, the petitioner is directed to submit a fresh representation ventillating all her grievances before the respondent no.7 annexing all the relevant papers and documents along-with certified copy of this order within a period of one week from today. If such a representation is made, the respondent no.7 is directed to take final decision on or before 30.6.2019.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
