Heard Sri Jitendra Pratap Singh, learned counsel for applicant, learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed by the applicant-wife seeking direction to the learned Principal Judge, Family Court, Gorakhpur to decide the Case No.639 of 2018 (Smita Shahi Vs. Rameshwar Shahi) under Section 125 Cr.P.C., P.S. Bansgaon, District Gorakhpur.
It is submitted by learned counsel for applicant that on account of lingering tactics adopted by opposite party no.2, who is husband of the applicant, the case could not be concluded and it is pending since 2018. The applicant is housewife having no source of income and is facing great financial crises on account of pendency of her application filed under Section 125 Cr.P.C.
In view of above, without commenting on the merits of the case, learned Principal Judge, Family Court, Gorakhpur is directed to expedite the matter and conclude the proceedings of the aforesaid case as early as possible without granting undue adjournment to either of the parties preferably within a period of four months from the date of production of copy of this order, unless there is any legal impediment.
With the aforesaid directions, the application is disposed of.
