Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the petitioner, upon instructions from his client, who is present in the Court, submits that he does not want to press any relief prayed for in the writ petition, except the prayer of extension of time for taking steps as mandated by the Division Bench of this Court in the earlier order dated 8.5.2014.
We have heard both the learned counsel for the parties.
The learned counsel for the petitioner, after taking instructions from his client is agreeable to deposit the principle amount as alleged and claimed by the Revenue with the revenue officials. However, he wants three weeks time to do so. Having felt that his prayer is reasonable, we pass the following order:
For a period of three weeks, nothing should be done pursuant to the show cause notice dated 23.4.2014. In the event, the aforesaid principle amount is deposited either in one go or in instalments within the above period, then the time granted earlier by this Court will stand extended for a period of three months from the date of completion of deposit of the full principle amount. In default of deposit of the full amount within the period as above, the order passed by us will stand recalled and the writ petition will stand dismissed and in that case, it would be open for the respondent-
authorities to proceed against the petitioner in accordance with law, as may be advised.
The writ petition is accordingly disposed of.
Consequently, the miscellaneous petitions, if any pending, shall also stand disposed of. No costs.
