JUDGMENT / ORDER

This writ petition has been filed seeking direction to the second respondent to evaluate the tender in Notification No.M-17/16-17 on 20.01.2017 without insisting upon the certificate of the third respondent (BIS).
2. This Court, by order dated 20.01.2017 has passed the following order :  Mr.M.Venkatachalapathy, learned Senior counsel for the petitioner, after some arguments submitted that the petitioner is not interested in making the application to the tender mentioned in Serial No.3. Therefore, there is no impediment for the respondents to go ahead with the opening of the tender as scheduled at 2.30 p.m today.
3. In view of the fact that the petitioner has already given an undertaking stating that there is no impediment for the respondents to go ahead with the opening of the tender, the prayer has become infructuous and accordingly, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
