S.K.M.Sabir Salik vs The Inspector Of Police

Madras High Court|24 November, 2017

JUDGMENT / ORDER

This criminal original petition has been filed by the petitioner to set aside the enquiry report dated 27.03.2012 submitted by the respondent in C.M.P.No.535 of 2012 on the file of the learned Judicial Magistrate, Alangudi and to direct the respondent herein to register the petitioner's complaint forwarded by the learned Judicial Magistrate, Alangudi, by its order dated 06.02.2012.
2.The learned senior counsel after elaborating his arguments would submit that though the petitioner sought for a larger relief in this petition, now restricted his claim to the effect that the petitioner may be permitted to file a protest petition before the Trial Court against the report filed by the respondent police, dated 27.03.2012.
3.Considering the limited request made by the learned counsel for the petitioner, I am inclined to issue a direction to the Trial Court to permit the petitioner to file a protest petition before the Trial Court, within a period of two weeks from the date of receipt of a copy of this order and this Court also directs the Trial Court to pass order on the protest petition to be filed by the petitioner, within a period of six weeks, thereafter.
4.Accordingly, this criminal original petition is disposed of.
Note: The Registry is directed to return the impugned order enable the petitioner to file a protest petition before the Trial Court.
To
1.The learned Judicial Magistrate, Alangudi.
3.The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
