2. Ramu Annamalai ... Respondents Writ petition has been filed under Article 226 of the Constitution of India, praying for a Writ of certiorari to call for the records pertaining to the summons of the first respondent dated 31.1.2017 and quash the same.
For Petitioner : Mr.C.K.M.Appaji For Respondents : Mr.C.Emalias, Addl. Public Prosecutor, for R1 ORDER The petitioner has come up with the present writ petition, challenging the summon dated 31.1.2017 issued by the first respondent.

It is the case of the petitioner that on the basis of the complaint dated 28.1.2017 given by the second respondent, the first respondent police asked the petitioner to attend for enquiry and when the petitioner appeared before the first respondent police on 31.1.2017, the first respondent police served a summon calling the petitioner to attend the police station on 2.2.2017 at 10.30 a.m., to enquire into the complaint preferred by the second respondent. Challenging the same, the petitioner has come up with the present writ petition.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that subsequent to the issuance of summon to the petitioner, First Information Report came to be registered in Crime No.154 of 2017 on the basis of the complaint given by the second respondent. Further, he has submitted that the petitioner's name does not find a place in the said First Information Report and his presence is not required for enquiry by the first respondent police related to the said case.
4. Since the petitioner is not required for enquiry by the first respondent police related to the case in Crime No.154 of 2017, I am of the opinion that nothing survives for adjudication in this matter. Hence, recording the said submission made by the learned Additional Public Prosecutor, the present writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
